Supreme Court Sets Aside Calcutta HC’s Order for CBI Inquiry into Bengal’s Post Creation

The Calcutta High Court’s ruling directing a CBI investigation into the West Bengal Cabinet’s plan to establish supernumerary positions in State-run and aided schools was partially overturned by the Supreme Court on Tuesday, April 8, 2025.

However, the top court made it plain that the CBI’s investigation into further aspects of the hiring of 25,753 teachers and workers in West Bengal’s State-run and aided school, as ordered by the Calcutta High Court, would continue.

In order to accommodate an employee who is entitled to a regular post that is now unavailable, a temporary position known as a “supernumerary post” is created.

A bench made up of Chief Justice Sanjiv Khanna and Justice Sanjay Kumar declared the entire selection process “vitiated and tainted” on April 3, invalidating the appointment of 25,753 teachers and staff members.
